Green Onion Landscaping's Terms and Conditions

1. The work

• The work or service is as described to the client either in the form of a formal quotation or detailed work schedule.

• Work or provision of materials will not take place unless the client signs and returns a Quotation Acceptance Form. This will be issued in the quotation process.

• Only work detailed in the quotation will be carried out. The quotation is a detailed and accurate appreciation of discussions and inspection agreed by the client.

• Alterations by the client or deviations from the original inspection will be treated as additional works and may lead to increases in rates.

• All work will be carried out by Green Onion Landscaping's experienced staff working with or supervised by one of the Green Onion Landscaping  partners when required.

• We carry full public liability insurance, a copy of the policy is available for viewing. We consider health and safety a key issue for our workforce.

2. Quotations and rates

• Quotations will remain valid for a period of 30 days. Green Onion Landscaping reserves the right to increase rates with prior notification to the client. This will relate only to factors outside Green Onion Landscaping's control, leading to price increases and being capable of verification. Examples are raw material increases, fuel price increases and minimum wage rate increases.

3. Additional work

• Work that is not included within Original Quotations and that are requested by the client, or client representative, will be treated as additional works. Green Onion Landscaping will provide detailed costs of additional work for the client's consideration. Once costs have been agreed in writing, Green Onion Landscaping will be happy to undertake the work requested.

4. Supply of materials and sundries

• Supplies of materials used to complete works remain the property of Green Onion Landscaping until full payment has been made by the client.

5. Machinery, tools and fuel

• Unless clearly specified by the Client, Green Onion Landscaping will provide Machinery, Tools and Fuel to undertake works that are detailed in the Quotation or work schedule.

6. Payments

• Invoices for all work will be issued directly the work is complete or materials have been supplied.

• Payment is due immediately unless otherwise agreed.

• Material money is always requested in full on written acceptance by the client of a Green Onion Landscaping quotation.

• We do not accept cheques. Payment can be made in cash or by BACS transfer direct to our business account.

• For maintenance contracts, invoices will be raised at the month end and are due for payment upon receipt.

7. Cancellation of work

• The notice period for cancellation of work is seven clear days (inclusive) from written acceptance of a formal Green Onion Landscaping quotation.

• Any unrecoverable costs incurred in respect of commitments made for material during that period will be charged in full to the client.

• For cancellation in excess of seven clear days (inclusive) from written acceptance of a formal Green Onion Landscaping quotation, 50% of all agreed fee rates will be charged in addition to any materials that have been purchased on behalf of the client or any other unrecoverable costs in respect of commitments made during that period e.g. machine hire contracts.

• Once paid for, any materials will become the property of the client and will be available for collection by the client or delivered to the client at agreed additional rates.

• Notice of cancellation must be made as soon as possible, initially by phone and then supported by written confirmation.

8. Customer care policy

• Green Onion Landscaping  is proud of the value, quality and dependability of the services it provides.

• If the client is not fully satisfied with any part of our service, then please inform us. We treat our clients concerns and comments as constructive and positive feedback and can only improve our services if informed of any shortcomings.

• If there is concern in regard to any aspect of the services we are contracted to undertake, the client must inform Green Onion Landscaping immediately in writing.

• We guarantee to investigate and respond to your concerns within 3 working days.

• The client will be responsible for all payments to Green Onion Landscaping unless otherwise notified in writing prior to commencement.
  
  
• The client shall provide water and electricity at no charge to Green Onion Landscaping.
  
  
• The client shall provide access to site during Green Onion Landscaping normal working hours and storage space for materials during the contract progress.
  
  
• Any addition and/or alterations to the schedule shall be properly treated as variations and subject to written instructions.
  
  
• Green Onion Landscaping is not able to accept responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection.
  
  
• Stage payments of against works completed/materials on site to be made at weekly intervals. Final payment to be made following completion and payable within 7 days of our invoice.
  
  
• Price to remain fixed until the end of 30 days . Acceptance before that date will ensure no increase in the cost of the works specified in the quotation.
  
  
• All, or any special conditions, of which Green Onion Landscaping has been informed are noted in the quotation.
  
  
• It is very important and the responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
  
  
• We accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.
  
  
• We are not able to accept responsibility for the well being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence.
  
  
• If necessary we reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.
  
  
• After practical substantial completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.
  
  
• Upon practical substantial completion the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established.
  
  
• Severe weather conditions, including drought, may cause the delay of the start date of the contract.
  
  
• Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.
  
  
• All materials on site remain the property of  Green Onion Landscaping until payment is received in full.
  
  
• Maintenance is not included in the contract unless specified and is chargeable.
