Green Onion Landscaping – Terms and Conditions
These Terms and Conditions apply to all quotations and contracts with Green Onion Landscaping (“The Contractor”). They are governed by and interpreted in accordance with the laws of England and Wales and are intended to ensure a clear, fair agreement that protects both parties. By signing a quotation or contract, The Client confirms acceptance of these Terms and Conditions.
1. Definitions
1.1 The following definitions apply:

The Contractor – Green Onion Landscaping and its employees.

The Client – the person(s), firm(s), or company entering into a contract with The Contractor.

Start Date – the date agreed between The Contractor and The Client for works to commence.

Intellectual Property – plans, drawings, and quotations supplied by The Contractor.

Site – the location where works are carried out.
-
Quotation/Contract – the written document including specifications, plans, or drawings describing the works.

Works – all landscaping, maintenance, or related services set out in the Quotation/Contract and any agreed variations.
1.2 Headings are for convenience only and do not affect interpretation.
1.3 Words in the singular include the plural and vice versa.
1.4 A “person” includes a natural person, corporate or unincorporated body, and their legal representatives, successors, and permitted assigns.
2. Quotations and Contracts
2.1 Quotations are valid for 30 days from the date shown. After this period, the quotation will lapse unless confirmed. If a project is not scheduled to begin within this period, prices are subject to change to reflect increases in supplier or material costs.
2.2 Quotations are based on conditions known at the time of inspection. Additional costs will apply if unforeseen circumstances arise (for example, hidden hazards or changes requested by The Client).
2.3 The Contractor may adjust prices due to external factors beyond their control, including but not limited to increases in raw material costs, fuel prices, or statutory wage rates.
2.4 The Client is responsible for securing any necessary planning permission, statutory consents, or approvals before works begin.
2.5 Works will not commence until The Client has signed the Quotation/Contract and paid the required deposit.
2.6 Only works listed in the signed Quotation/Contract will be carried out. Any additional works must be agreed in writing and may require separate payment.
3. Client Responsibilities
The Client agrees to:

Provide timely possession of the site and safe access during normal working hours (Winter: 8am–4pm including Saturdays; Summer: 7.30am–5pm).

Provide water, electricity, and (where possible) toilet facilities at their own cost.

Ensure the site is free of undisclosed hazards (for example, underground pipes, cables, drains, foundations, stumps, or wells).

Remove garden furniture, ornaments, plant pots, play equipment, and pet waste before work begins.

Keep children, pets, and visitors away from work areas for safety reasons.
-
Take responsibility for the safety of family members, visitors, and animals on site.
-
Inform The Contractor of any neighbour disputes or issues that may delay works.

Avoid engaging in unnecessary or lengthy conversations with staff, as this will slow progress, delay completion of the project, and in turn affect other clients’ scheduled start dates.
4. Scope of Work
4.1 The Contractor shall complete the works described in the Quotation/Contract to a professional standard.
4.2 No additional work will be undertaken unless agreed in writing.
5. Materials and Living Products
5.1 Materials delivered to site become The Client’s responsibility. The Contractor accepts no liability for loss, damage, or theft after delivery.
5.2 Surplus materials remain the property of The Contractor and may be removed.
5.3 Living products (plants, turf, hanging baskets, wreaths) are perishable. The Client is responsible for watering, feeding, and aftercare once delivered or installed.
5.4 No guarantee is given for survival or condition of living products after delivery. Exchanges are only possible if issues are reported immediately on the same day of delivery.
5.5 The Contractor cannot be held responsible for deterioration caused by neglect, under/overwatering, or pests.
6. Payments and Deposits
6.1 Payments are due on the day of completion, unless stage payments have been agreed.
6.2 Overdue accounts will incur interest at 5% above The Contractor’s bank’s base rate until cleared.
6.3 Payment methods: bank transfer or cash (receipts issued for all cash payments). Cheques and credit cards are not accepted.
6.4 Deposits:

20% deposit required to secure a work date.
-
30% further payment due one week prior to commencement.
-
50% balance due on completion day.
6.5 For projects exceeding two weeks, stage payments will be required at weekly intervals.
6.6 Deposits above 50% may be required if materials exceed half of project value or for subcontracted services (for example, electricians/bricklayers/skips/grabman).
7. Cancellations
7.1 The Client must give 30 days’ notice prior to the start date to cancel works.
7.2 Any unrecoverable material costs will be charged in full.
7.3 Cancellations with less than 30 days’ notice will result in:

50% of all agreed fees charged.
-
Costs of purchased materials or hire contracts charged in full.
-
Deposits retained to cover losses.
7.4 Notice must be given by telephone and confirmed in writing via registered post or email (to Andrew Smith, info@green-onion.co.uk).
8. Delays and Disruption
8.1 The Contractor will make reasonable endeavours to complete works on time, but is not liable for delays caused by weather, illness, force majeure, or other events beyond control.
8.2 Start/completion dates may be rescheduled in cases of:

Severe weather (frost, heavy rain, drought, extreme heat, snow).

Staff illness or bereavement.
-
Third-party contractors employed by The Client causing delays.
8.3 Clients will be informed of any changes as soon as practicable.
9. Liability and Insurance
9.1 The Contractor accepts no responsibility for:
-
Hidden hazards not disclosed in writing or visible during inspection.
-
Damage caused by weather after completion.
-
Damage caused by The Client, visitors, neighbours, or unrelated third parties.
-
Theft or loss of materials once delivered.
-
Electrical appliances unplugged or switched off during works.
9.2 The Contractor holds full public liability insurance. In the unlikely event of accidental damage caused directly by The Contractor’s negligence, the matter will be dealt with through the insurance provider.
10. Photographs and Marketing
10.1 The Contractor reserves the right to take photographs/videos of works for use on their website and social media.
10.2 Any photographs provided by The Client may also be used for marketing purposes.
11. Additional Work
11.1 Any work not listed in the original Quotation must be agreed in writing.
11.2 Additional works may be carried out during the project if possible, or scheduled separately.
11.3 Additional works will be subject to quotation and deposit before commencement.
12. Specialist Work
12.1 Tree Felling

The Client must remove breakables from the work area.
-
The Contractor cannot be held responsible for breakages caused by falling branches or trunks.
-
Clients, pets, and children must remain indoors during tree felling.
12.2 Tree Preservation Orders (TPOs) and Conservation Areas
-
The Client must inform The Contractor if any trees are subject to a Tree Preservation Order (TPO) or located within a Conservation Area.
-
It is The Client’s responsibility to obtain written consent from the local council before works commence.
-
The Contractor will not carry out works until the appropriate permissions have been granted, and accepts no liability for delays, fines, or enforcement actions resulting from undisclosed restrictions.
12.3 Tree Stump Removal
-
Breakables must be removed from the work area.
-
Stump grinding may disturb nearby plants.
-
The Contractor will tidy the area but some visible evidence of stump removal will remain.
-
Clients must remain indoors during works for safety.
12.4 Drainage Works
-
The Client is responsible for obtaining Water Board permission.
-
The Contractor assumes permission has been granted and accepts no liability for issues with existing drainage systems after connection.
12.5 Waste Disposal

The Contractor is a registered green waste carrier and may only remove green waste produced by their works.
-
Household or other waste will not be removed.
13. Customer Care Policy
13.1 Green Onion Landscaping is committed to providing high-quality, dependable services.
13.2 If The Client is not satisfied with any aspect of work, they must notify The Contractor in writing immediately.
13.3 Feedback is welcomed as a means of continuous improvement.
13.4 These Terms and Conditions do not affect your statutory rights.
14. Additional Terms for Maintenance Contracts
14.1 Maintenance services run February–December (depending on weather conditions)and may be one off garden clearances, weekly, fortnightly, or monthly jobs.
14.2 Clients must ensure access is available on scheduled visits. Absence may result in cancellation of the contract and retention of advance payment.
14.3 Contracts may be altered or cancelled by The Client with 14 days’ written notice. Refunds will be made for advance payments if notice is given.
14.4 If visits are cancelled or left too long, additional charges will apply to restore overgrown gardens.
14.5 The Client must remove pet waste, hazardous waste, litter, furniture, or obstacles prior to each visit.
14.6 Pets and children must be kept indoors during visits for safety.
14.7 While The Contractor will endeavour to send the same operative, this cannot be guaranteed. All staff are fully trained.
14.8 Requests for extra tasks must be made in advance and will be charged separately.
